How Medical Malpractice Lawsuits Are First Handled.

Each state in the US licenses the doctors who practice in it. The medical examining board will take a complain and bring it before a panel of doctors and lawyers for review.

If evidence is found that a violation of the law or ethical code has taken place, the panel may decide to bring the case up in front of the State Medical Board.

Depending on the complaint, if the doctor is found guilty, he or she could face formal reprimand, suspension, or medical license revocation.

The medical Board will also look into billing complaints involving the doctor. The board will contact the doctor for his/her side of the dispute and then decide what actions will be taken to resolve the dispute.

Most common negligence claims and complaints on medical malpractice lawsuits:

Improper use of the anesthetic agents, oxygen, and other substances and equipment

Delays in treatment or failure to obtain proper consent for treatment.

Surgical Errors serious side effects can occur when the surgery is performed incorrectly.

Injury to a patient resulting from a medical professional making an incorrect diagnosis.

The doctor charges for procedures that weren’t performed.

The doctor Misuses Prescription Drugs or a Medical Device.

The doctor makes sexual advances toward the patient.

The surgeon leaves an object inside the patient’s body.

Child delivery complications that can cause malformations, birth injury, cerebral palsy, or brain damage.

The patient is not satisfied with the plastic surgery results.

Medical malpractice costs are growing at a rate of 7.5 percent annually. In 2005, it totaled over $30 billion.
